DOL Interpretation: Mortgage Loan Officers Not 'Exempt' Employees

A Labor Department interpretation issued March 24 effectively overturns agency guidance that had exempted mortgage loan officers – and others performing the same function – from the overtime requirements of the Fair Labor Standards Act.

The industry was previously successful in obtaining guidance that indicated mortgage loan officers were exempt as long as their primary duty was not selling the employer's products. But the new interpretation finds that generally mortgage loan officers are, in fact, selling their employers' financial products. ABA is working with others in the industry to determine the appropriate next steps to deal with the issues raised by this Interpretation. Read the interpretation.
